Terms of Service

1. Scope of These Terms

These Terms of Service (“Terms”) govern your use of the website devworld-llc.com, the customer portal (account.devworld-llc.com), the license API (api.devworld-llc.com), and all digital products, software licenses, and services offered through them (the “Services”) provided by DevWorld LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, USA (“DevWorld”, “we”). By creating an account or purchasing a product you agree to these Terms.

2. Accounts

Purchases require a customer account. You represent that the information you provide is accurate, you will keep your credentials confidential, and you are responsible for all activity under your account. The Services are intended for businesses, clubs, and adults.

3. Products, Licenses, and Open Source

Purchased or granted licenses are represented by license keys and are valid for the number of devices or installations stated for the product. License keys are personal to the customer and may not be resold, rented out, or made publicly available.

Certain software (e.g. “Gym141”) is published as open-source software under the MIT license; such software is governed by its open-source license. What you pay for are additional services such as feature entitlements, expanded usage tiers, updates delivered through our servers, and support (“License Services”). These Terms govern the License Services, not the open-source software itself.

4. Subscriptions and Billing

Subscriptions renew automatically for the billing period you selected (e.g. 1, 3, 6, or 12 months) until cancelled. Payments are processed by our payment provider, Stripe, whose terms apply in addition. Cancellation takes effect at the end of the paid period; periods already paid for remain usable. We will announce price changes at least 30 days in advance; they apply from the next billing period.

5. Refunds

To the extent permitted by law, payments are non-refundable. If you experience technical problems, made a purchase in error, or were charged twice, please contact us – we will usually find a fair solution.

6. Acceptable Use

You must not, in particular: share or sell license keys to third parties; attack, disrupt, or overload the portal or the API; circumvent access or payment mechanisms of the Services; or use the Services for any unlawful purpose. We may suspend accounts and revoke licenses in case of violations.

7. Availability and Support

We operate the Services with reasonable care but do not guarantee uninterrupted availability. License checks include grace periods so that short outages do not affect your software. Support is provided to the extent described for the respective product.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVWORLD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOSS OF DATA. DEVWORLD’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO DEVWORLD IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You will indemnify and hold DevWorld harmless from third-party claims arising out of your unlawful use of the Services or your breach of these Terms.

11. Term and Termination

You may close your account at any time. We may suspend or terminate accounts for material breaches of these Terms. Sections 8–10 and 13 survive termination.

12. Changes to These Terms

We may update these Terms with effect for the future. We will announce material changes in the portal or by e-mail; continued use after the effective date constitutes acceptance.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, USA, excluding its conflict-of-law rules. Exclusive venue lies with the state and federal courts located in Sheridan County, Wyoming, USA. Mandatory consumer protections of your country of residence remain unaffected to the extent they cannot be waived.

14. Language

These Terms are drafted in English; translations are provided for convenience only. In case of discrepancies, the English version prevails.
